Terms of Service & Charter Conditions

These Terms of Service and Charter Conditions (“Terms”) govern your use of texas-yacht.com and any charter inquiry, account registration, or booking made through Recondo Marine LLC, doing business as Texas Yacht Charters (“Texas Yacht Charters,” “we,” “us,” or “our”).

By accessing this website, submitting an inquiry, creating an account, or booking a charter, you agree to these Terms.

1. Website Use

This website is provided for informational and booking purposes only. We may update content, availability, pricing, or policies at any time without notice. Unauthorized use of the site or its content is prohibited.

2. Bareboat Charter Relationship (Important)

All charters offered are bareboat (demise) charters.

You, the charterer:

Select your captain directly

Select the route, itinerary, and agenda

Direct the captain as you see fit

Captains:

Are not employees or agents of Texas Yacht Charters

Are independent mariners who are credentialed and insured

Work for you, not for us

However, the captain retains ultimate responsibility for the safety of the vessel and all persons onboard and may refuse to carry out any instruction that would endanger persons or the vessel.

Nothing in these Terms shall be interpreted to create a crewed charter, carrier relationship, or employment relationship.

3. Booking & Payment

A booking is not confirmed until payment or deposit is received.

Payments are processed by third-party payment providers.

Texas Yacht Charters does not store credit card information.

4. Cancellation & Refund Policy

Charterer Cancellations

Deposits are refundable up to seven (7) days before the scheduled charter start time.

Weather & Safety Cancellations

A charter may be canceled for safety reasons when conditions are not suitable, including but not limited to:

Average wave height over 2 feet

Sustained winds over 20 knots

Temperature below 32°F

Thunder or lightning

Named storms

Heavy rain

Safety cancellations may be made by the captain or Texas Yacht Charters.

Refund Method

Approved refunds are issued to the original payment method.

5. Late Arrivals & No-Shows

Charter time starts and ends at the booked times, regardless of arrival time.

Late arrival does not extend the charter.

Extensions may be possible only if the vessel is available and are subject to additional fees for the vessel and crew. Any extension must be discussed directly with the captain.

6. Alcohol & Conduct

Alcohol is permitted onboard where lawful.

The charterer is fully responsible for alcohol consumption and guest behavior.

The captain may refuse service, modify activities, or take safety actions if conduct becomes unsafe.

Illegal drugs, dangerous behavior, or violations of law are prohibited.

7. Passenger Safety

All passengers must comply with:

Applicable maritime laws and regulations

Captain safety instructions

Posted vessel rules

Terms and conditions in the charter contract

Failure to do so may result in modification or early termination of the charter without refund.

8. Damage & Financial Responsibility

The charterer is financially responsible for:

Damage to the vessel

Loss or damage to equipment

Excessive cleaning or repair costs

This responsibility applies regardless of fault among guests.

9. Limitation of Liability

To the fullest extent permitted by law:

Texas Yacht Charters is not liable for personal injury, death, property loss, or delays arising from charter activities.

Charters involve inherent maritime risks. Participation is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless Texas Yacht Charters from any claims, damages, or expenses arising from:

Your charter

Actions of you or your guests

Violation of these Terms

11. Mobile Messaging Terms (SMS)

By providing your mobile phone number during account registration, charter inquiry submission, captain onboarding, or booking, you agree to receive automated transactional text messages from Texas Yacht Charters related to your charter or account activity.

Messages may include:

Booking confirmations

Availability requests (for captains)

Charter coordination and scheduling updates

Arrival and boarding instructions

Responses to inquiries you initiate

Message frequency varies depending on booking and account activity.

Message and data rates may apply.

Consent to receive SMS messages is not required as a condition of purchase.

Messages may be sent using an automated messaging system.

You may opt out at any time by replying STOP to any message received.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Texas.

Any dispute shall be brought exclusively in Galveston County, Texas.
